PRIVACY POLICY STATEMENT – PREFERRED ALTITUDE, LLC


INTRODUCTION

This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from preferredaltitude.com (the “Site”).  By visiting our site and/ or purchasing something from us through our “Store”, you also engage in our “Service” and agree to be bound by the following Privacy Policy.


SECTION 1 – WHAT PERSONAL INFORMATION DO WE COLLECT FROM YOU AND WHAT DO WE DO WITH YOUR INFORMATION?

When you visit the Site and/or purchase something, or attempt to make a purchase through the Site/from our Store, as part of the buying and selling process, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.  We refer to this information as “Order Information.”

When you browse our Site you may voluntarily supply your information to us, for example if you are interested in providing feedback or being on our mailing list (also see Email marketing below).

When you browse our Site we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

When you interact with our Site’s social media presence on any social media platform (including, but not limited to, Facebook, Twitter, and Instagram), either directly on that social media platform or via plug-ins to those platforms on our Site or social media sites, we may collect your personal information from you from your public social media profile(s).  Note that these social media platforms have their own privacy policies and terms and conditions that you will also be bound to.

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information.

We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).  Additionally, we use this Order Information to:
Communicate with you; Screen our orders for potential risk or fraud; and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

General marketing:  We may send you postal marketing materials about our Site/Store, new products and other updates and information, including but not limited to newsletters and coupons.

Email marketing : With your permission, we may send you emails about our Site/Store, new products and other updates and information, including but not limited to newsletters and coupons. By supplying your email address you give us permission to communicate with you via that email address.

Customer service: We may use your Personal Information to communicate with you to provide customer service and support and in efforts to make our products and service better.

Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above.  Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the Site, or attempt to place an order with the site, we intend to maintain your Order Information for our records unless you ask us to delete this information.  When you sign up for our newsletter, we intend to maintain your this information for our records unless you ask us to delete this information.


SECTION 2 - CONSENT

How do you get my consent?

When you provide us with Personal Information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that purpose.

When you provide us your Personal Information for a secondary reason like contacting us via email or telephone, we imply consent to our collecting it and using it to contact you back to address your inquiry.

If we ask for your Personal Information for a secondary reason, like marketing, newsletters, etc, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.


How do I withdraw my consent?

SECTION 3 - DISCLOSURE

We may disclose your Personal Information to third parties for the purpose of communicating with you, for the purpose of creating, completing and fulfilling any order(s) and/or transactions you submit to us, and for appropriate business services (such as accounting). You understand, acknowledge, and agree to having your content and Personal Information transferred to third parties for the purpose of communicating with you, for the purpose of creating, completing, and fulfilling any order(s) and/or transaction(s), and for business services. You understand, acknowledge and agree that these third parties may be subject to disclosure of your Personal Information as required by applicable law.

We may disclose your Personal Information if we are required by law to do so or if you violate our Terms of Service or related agreement(s) to the Service.

We may disclose your Personal Information to third parties in the event that action or investigation is necessary regarding illegal acts/activities and/or the potential that a person's physical safety is being threatened, and/or fraud that is suspected.

In the event that another company acquires our company or business in any way, we may share Personal Information with them.

Personal Information may be compiled into aggregate form for our business use and/or disclosed to third-parties for business purposes.


SECTION 4 - SHOPIFY

Our Store is hosted on Shopify Inc (“Shopify”). They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

By using our site and Store, you are also bound by Shopify's privacy policy, which can be found at https://www.shopify.com/legal.

Payment:

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover.

PCI-DSS requirements help ensure the secure handling of credit card information by our Store and its service providers.

Shopify and its partners and vendors may process, transfer and store your Personal Information outside of the United States.

SECTION 5 - THIRD-PARTY SERVICES


In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, including, but not limited to, fulfillment services, payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions, and for appropriate business services. This also includes non-purchase transactions where you have voluntarily supplied your information to us.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your Personal Information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our Site/Store or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

SECTION 6 - SECURITY

To protect your Personal Information, we take reasonable precautions and follow reasonable practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Email, websites, and internet transmissions that are unencrypted are used to communicate non-credit-card information about your order to you, to us, and to third parties to allow them to perform the services they provide to us.

If you provide us with your credit card information, the information is encrypted by Shopify using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure,  Shopify follows all PCI-DSS requirements and implement additional generally accepted industry standards.

You understand, acknowledge, and agree that your Personal Information may be processed, transferred and stored outside of the United States.

You understand, acknowledge, and agree that no computer systems or networks can be guaranteed to be safe and secure and the potential for your content and Personal Information to be obtained by third-parties is always a possibility.


SECTION 7 – COOKIES & DO NOT TRACK

Please note that Shopify does not take any specific automated action in response to web browser Do Not Track signals or other similar mechanisms.

SECTION 8 - AGE OF CONSENT

The Site/Store is not intended to be used by anyone under the age of 18.  By using this site, you represent that you are at least the age of majority in your state or province of residence.


SECTION 9 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated (via the “Last updated on” date), so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

If our Site/Store is acquired or merged with another company, your information may be transferred to the new owners.


SECTION 10 – TERMINATION OF RELATIONSHIP WITH US

Upon termination of your relationship with us, your Personal Information may continue to be stored via archival data for business purposes and legal compliance. We may also continue to store information that is anonymous, or has been anonymized, for business purposes including, but not limited to, the purpose of improving the Service.
